TERMS & CONDITIONS

1. Definitions

  • The Photographer: Lesauvage Media
  • The Client: The individual or organisation named on the invoice
  • Images: All photographs and related content created by the Photographer
  • Reproduction: Any form of copying, publication, display, alteration, or distribution in any medium

2. Governing Law

These Terms and Conditions are governed by the laws of England and Wales and may only be varied with the Photographer’s written agreement.

COPYRIGHT

3. Ownership

All website content and commissioned images remain the copyright of the Photographer unless otherwise agreed in writing.

4. Rights

The Photographer’s rights are asserted under the Copyright, Designs and Patents Act 1988. Unauthorised use, copying, or distribution is prohibited.

USAGE TERMS

5. Actor / Performer / Model Headshots

Usage is granted for self-promotion only, including agents, casting platforms, websites, print, and personal social media.

Commercial use, advertising, or paid promotion requires prior written consent and an agreed licence fee.

6. Corporate / Business / Professional Headshots

Usage rights are agreed at the time of booking and limited to the purpose stated on the invoice. This may include:

  • Personal self-promotion
  • Internal company use
  • Public company use (websites, marketing, reports)
  • PR and press distribution
  • Editorial use as agreed

Any use outside the agreed scope requires written permission.

PAYMENT

7. Fees

  • Individual clients: full payment is due on the day of the shoot unless agreed otherwise
  • Organisations: 50% is due on the shoot day, with the balance payable upon delivery of final images

Late payments may be subject to statutory interest.

PROMOTIONAL USE

8. Photographer Promotion

Unless otherwise agreed, the Client grants permission for selected images to be used by the Photographer for self-promotion, including websites, portfolios, and marketing materials.

LIABILITY

9. Limitation

The Photographer is not liable for indirect losses or third-party claims. Liability for defective work is limited to correction or refund.

In the event of total image failure, liability is limited to a full refund of fees paid.

Clients and participants follow directions at their own risk. The Photographer is not responsible for personal injury or property damage during a shoot.

CREATIVE CONTROL

10. Artistic Licence

The Photographer retains creative control over style, posing, locations, and retouching.

COMPLAINTS

11. Complaints

Any complaints must be made in writing within 21 days of image delivery.

CHANGES

12. Amendments

The Photographer reserves the right to amend these Terms and Conditions. Confirmed bookings are not affected by later changes.
